ARTICLE 38
SEVERABILITY
In the event that any provision of this MOU becomes
invalid or void by statute, legislative action or final judicial decision by a
court of competent jurisdiction, or in the event that any provision conflicts
with the provisions of a statute or the Constitution of the United States or
California, according to such final judicial decision, such action shall not
invalidate the entire MOU. It is
the express intention of the parties that all other provisions not declared
invalid or void shall remain in full force and effect. In the event that any provision of this
MOU becomes invalid or void, the parties agree to meet within thirty (30)
calendar days upon request of either party in an attempt to reach an agreement
on a substitute provision.
